Court Rules Software Not Protected By Fed Crime Laws, Overturns Conviction of Goldman Engineer

High frequency trading-thumb-225x149Before leaving Goldman Sachs to earn a millionaire?s salary with Chicago High Frequency Trading (HFT) startup Teza Technologies, Sergey Aleynikov made one last transaction. At 5:20pm on his last day, just before his going-away party, Aleynikov uploaded 500,000 lines of encrypted source code from the Wall Street firm's proprietary HFT system to a server located in Germany. Following the clandestine upload, Aleynikov deleted the encryption program, wiped his command history, and headed to the party. Although Aleynikov later managed to download the source code to his home computer in New Jersey before flying to Chicago, he was apprehended by the FBI while returning through Newark Liberty International Airport. But after his conviction at trial and imprisonment during the appeals process (his dual US-Russian citizenship presented a flight risk), Aleynikov is now a free man. The reasons why touch the entire software industry.

New method to prevent undersea ice clogs

Wednesday, April 11, 2012

During the massive oil spill from the ruptured Deepwater Horizon well in 2010, it seemed at first like there might be a quick fix: a containment dome lowered onto the broken pipe to capture the flow so it could be pumped to the surface and disposed of properly. But that attempt quickly failed, because the dome almost instantly became clogged with frozen methane hydrate.

Methane hydrates, which can freeze upon contact with cold water in the deep ocean, are a chronic problem for deep-sea oil and gas wells. Sometimes these frozen hydrates form inside the well casing, where they can restrict or even block the flow, at enormous cost to the well operators.

Now researchers at MIT, led by associate professor of mechanical engineering Kripa Varanasi, say they have found a solution, described recently in the journal Physical Chemistry Chemical Physics. The paper's lead author is J. David Smith, a graduate student in mechanical engineering.

The deep sea is becoming "a key source" of new oil and gas wells, Varanasi says, as the world's energy demands continue to increase rapidly. But one of the crucial issues in making these deep wells viable is "flow assurance": finding ways to avoid the buildup of methane hydrates. Presently, this is done primarily through the use of expensive heating systems or chemical additives.

"The oil and gas industries currently spend at least $200 million a year just on chemicals" to prevent such buildups, Varanasi says; industry sources say the total figure for prevention and lost production due to hydrates could be in the billions. His team's new method would instead use passive coatings on the insides of the pipes that are designed to prevent the hydrates from adhering.

These hydrates form a cage-like crystalline structure, called clathrate, in which molecules of methane are trapped in a lattice of water molecules. Although they look like ordinary ice, methane hydrates form only under very high pressure: in deep waters or beneath the seafloor, Smith says. By some estimates, the total amount of methane (the main ingredient of natural gas) contained in the world's seafloor clathrates greatly exceeds the total known reserves of all other fossil fuels combined.

Inside the pipes that carry oil or gas from the depths, methane hydrates can attach to the inner walls ? much like plaque building up inside the body's arteries ? and, in some cases, eventually block the flow entirely. Blockages can happen without warning, and in severe cases require the blocked section of pipe to be cut out and replaced, resulting in long shutdowns of production. Present prevention efforts include expensive heating or insulation of the pipes or additives such as methanol dumped into the flow of gas or oil. "Methanol is a good inhibitor," Varanasi says, but is "very environmentally unfriendly" if it escapes.

Varanasi's research group began looking into the problem before the Deepwater Horizon spill in the Gulf of Mexico. The group has long focused on ways of preventing the buildup of ordinary ice ? such as on airplane wings ? and on the creation of superhydrophobic surfaces, which prevent water droplets from adhering to a surface. So Varanasi decided to explore the potential for creating what he calls "hydrate-phobic" surfaces to prevent hydrates from adhering tightly to pipe walls. Because methane hydrates themselves are dangerous, the researchers worked mostly with a model clathrate hydrate system that exhibits similar properties.

The study produced several significant results: First, by using a simple coating, Varanasi and his colleagues were able to reduce hydrate adhesion in the pipe to one-quarter of the amount on untreated surfaces. Second, the test system they devised provides a simple and inexpensive way of searching for even more effective inhibitors. Finally, the researchers also found a strong correlation between the "hydrate-phobic" properties of a surface and its wettability ? a measure of how well liquid spreads on the surface.

The basic findings also apply to other adhesive solids, Varanasi says ? for example, solder adhering to a circuit board, or calcite deposits inside plumbing lines ? so the same testing methods could be used to screen coatings for a wide variety of commercial and industrial processes.

'Avengers' Choreographer Outlines The Art Of The Superhero Fight

Writer/director Joss Whedon talks to MTV News about the challenges of putting Captain America and Thor in the same brawl.

Despite the seemingly endless Internet speculation about the plot of "Marvel's The Avengers", if there's one thing that we can absolutely count on seeing in the film when it opens is superhero-on-superhero fights.

We've seen brief teases of these expectedly awesome and epic battles in the trailers, several of which occur in the blink of an eye and with heavy assists from CGI, and no matter how beautiful they appear onscreen, we can't help but wonder how the filmmakers developed those complicated scenes without occasionally confusing which superhero has which superpower.

When MTV News caught up with the film's master choreographer himself, writer/director Joss Whedon, we asked him how he managed to keep all the super suits, super soldiers, demigods and archers separate when choreographing between such diverse characters.

"The big challenge was a) not to let it be generic, for it to be something we haven't seen before, but mostly to remember everybody's skill set," Whedon said at the film's red-carpet premiere on Wednesday. "The fight choreographer might come up with something where Hawkeye, Captain America and Thor are all doing the same thing and it's like, 'Well no, they all have very different levels of power,' and to sort of honor that reality for each one of them."

We followed up that question with another heavy-hitter: now that Whedon has tamed the beast that is this massive undertaking — which includes a pressure cooker of elements including a big budget, huge cast and satisfying fanboy expectations — how much vacation time will he need until he can think about another "Avengers" movie?

"17 years in a tiny cave," Whedon said. "In Tibet."

Perhaps we might be waiting awhile for that "Avengers" sequel.

Check out everything we've got on "Marvel's The Avengers."

Celtics shoot past Heat, 115-107

MIAMI (AP) ? A week ago, the Boston Celtics beat the Miami Heat with defense. This time, they did it with offense.

Paul Pierce scored 27 points, Kevin Garnett added 24 points and nine rebounds, and the Celtics made their first eight shots of the fourth quarter to hold off the Heat 115-107 on Tuesday night.

Rajon Rondo posted double-digit assists for the 18th straight game, extending the NBA's longest such streak in 20 years with an 18-point, 15-assist effort. Brandon Bass added 12 points and 10 rebounds, while Avery Bradley scored 11 for the Celtics, who shot a season-high 61 percent and survived two possessions where Miami could have tied the score in the final quarter.

"We talk about it in fighting terms," Celtics coach Doc Rivers said. "We told them today before the game, you're in a boxing match, you expect to get hit. They're going to hit you. They did and we withstood it. I thought that was important for our team."

LeBron James finished with 36 points, seven rebounds and seven assists for Miami, which got 20 from Dwyane Wade and 18 from Mario Chalmers. Chris Bosh finished with 13 on 5-for-13 shooting for Miami, which has gone 5-5 in its last 10 games.

The Celtics beat Miami 91-72 in Boston on April 1, a game the Heat called "unacceptable" after establishing season-lows in scoring and shooting.

This one won't sit much better with the reigning Eastern Conference champions, who ousted the Celtics in five games from last year's playoffs and could see them in the second round of the upcoming postseason. No team had shot better than 55 percent against the Heat this season, and Boston's 115 points were two shy of matching a season-high against Miami.

"We left Boston feeling awful at our performance," James said. "I don't feel as bad tonight. Those guys, they were locked in. Not only did they make their open shots, they made their contested shots. ... When you've got it going like that, just tip your hat off. We tip our hat off to them tonight. They won it."

Boston improved to 18-7 since the All-Star break, and dealt Miami a blow in the race for the No. 1 seed in the East. The Heat fell three games behind Chicago after the Bulls beat the New York Knicks later Tuesday night.

"It took a while," Rondo said, "but we're peaking at the right time."

A layup by Wade got Miami within 108-103 with 2:22 left, before Garnett made a high-arcing jumper that dropped softly through the net, his 11th make in 14 shots.

That pretty much described the night. Whenever Miami got close, the Celtics found a way to hold them off.

"It's a game of runs," Pierce said. "You have one of the best teams in the NBA at home. You know they're going to make a run. That's what makes them who they are. They know how to turn it on. We did a good job of holding their runs to a minimum."

Miami had two shots to tie early in the fourth after being down by as many as 18 earlier, before Garnett made jump shots on four straight possessions, the average length of those makes being 19 feet.

A 10-0 run early in the first quarter gave Boston a quick lead ? and that wasn't even the Celtics' best run of the opening period. Boston scored the last 11 of the first, the run actually becoming 13-0 when Garnett scored to open the second quarter, and Boston's lead was 35-22.

Everything the Celtics wanted, they got. Boston shot 61 percent in the first quarter, 62 percent in the second. Rivers used eight players, all of them making multiple shots by halftime. Of them, the only one who failed to make at least half his shots was Bass, who more than made up for that with six first-half rebounds.

Here's how well the Celtics were shooting: Miami went into the break shooting 51 percent from the field, 60 percent from 3-point range and 78 percent from the foul line ? and Boston was at least 10 percentage points better in every department.

"None of us were expecting that," Heat coach Erik Spoelstra said. "To give up 115 points on our home floor, that's not our style. And we're being made to feel uncomfortable right now. That's really the residual of the last three weeks or so. This is probably the one silver lining out of it, is our group, staff and players, we're getting to know each other now on the level that is needed for us to prepare for the playoffs.

"We all know we have to take a real big step forward as a basketball team," Spoelstra added.

The next chance for that "big step" comes Thursday, when the Heat visit Chicago.

Down by 18 in the first half, Miami cut the deficit to 65-57 at halftime. James closed it with a 3, punching the air as the shot dropped.

Even with that, every moment of the second half was an uphill battle.

And the Celtics weren't being caught.

Miami got within five twice in the third, with Rondo answering both times to make it a three-possession game again. The Celtics held the Heat to 36 percent shooting in the quarter, keeping the eight-point lead entering the fourth at 89-81.

The Heat had two chances to tie early in the fourth, after starting the period on a 7-0 run. The first of those slipped away when Bosh failed to finish off a three-point play opportunity by missing from the line. The next came when Udonis Haslem missed from the left baseline with 9:17 left, and Boston's answer that time was absolute.

Allen made a catch-and-shoot 3 for a 94-89 lead, and then Garnett just took over.

"When they shoot like that, it's going to be tough to beat them," Wade said. "Obviously, we can always do things better. But give them credit."

NOTES: Alex Terrio, a fan wearing a Heat T-shirt, won a 2012 Kia Optima for making a halfcourt shot in between the third and fourth quarters. "Shock," Terrio said. ... James had 11 points in the third quarter for the third consecutive game. ... Hall of Fame quarterbacks Dan Marino and Jim Kelly were at the game, as was Chicago Bears star Julius Peppers.

JC Penney CFO Dastugue leaving the company

(AP) ? J.C. Penney Co.'s Chief Financial Officer Michael Dastugue will leave the company Friday in the wake of a broader shakeup of the department store operator's business.

The company said Wednesday that Chief Operating Officer Michael Kramer will serve as interim CFO while it looks for a permanent replacement.

Kramer joined J.C. Penney in December, after serving for three years and president and CEO of Kellwood Co. He was also executive vice president and CFO at Abercrombie & Fitch Co. and served as CFO of Apple's retail division.

The announcement comes less than a week after J.C. Penney said it laid off 600 workers, or 13 percent of the staff at its headquarters in Plano, Texas, as the company looks to streamline its operations. It will also eliminate 300 more jobs at its customer call center in Pittsburgh when it closes the center July 1.

The company's new CEO, former Apple Inc. executive Ron Johnson, is transforming every aspect of Penney's business, from pulling back on constant promotions to rethinking the brands it carries. Johnson became CEO on Nov. 1.

In recent years Penney has suffered because its core middle-income customers have been among those hardest hit by the weak economy. It's also lagged behind rivals like Macy's Inc. making its stores fun places to shop. In its latest fiscal year ended Jan. 28, Penney reported a loss of $152 million on revenue of $17.26 billion. That compares with a profit of $389 million on revenue of $17.76 billion in the same period last year.

Revenue at stores open at least a year, considered a key indicator of a retailer's health, rose a slim 0.2 percent for the latest fiscal year. Rival Macy's Inc. enjoyed a 5.3 percent increase.

J.C. Penney has 1,100 stores. Its stock added $1.03, or 3.1 percent, to $34.24 in midday trading. Over the past year, the shares have traded between $23.44 and $43.18.

Business Ethics and Judaism: A Matter of Principle

From giant corporations, banks, Wall Street and accounting firms to governments and non-profits, how America conducts business has been called into question during the current economic crisis. Greed, ambition and poor regulation have been raised as culprits by talking heads on TV, newspaper and online. Ethics ? the lack of, has been raised less often.

JBN asked five experts for their view of ethics as it relates to business.

Longtime legal scholar Alan Dershowitz, holder of Harvard?s Felix Frankfurter professorship, teaches a course on legal ethics that covers several professions.

?One has to make a distinction between personal morality and ethics. Ethics are determined by the rules of a profession,? said Dershowitz. ?Every profession has it,? he said pointing to journalism and business. ?You come across something, but you can?t disclose your source. In business, a fiduciary obligation to stock holders may be inconsistent with personal morality.?

According to Dershowitz, choices are not easy. ?I teach a class about conflict. The choices are not between good, better and best. Often, they?re between bad, worse and worst,? he said.

However, he thinks business ethics are improving. ?They?re getting better because there?s more public scrutiny. Journalists are reporting more on business?.. the more sunlight, the better,? he said, ?Business can no longer operate in utter secrecy.?

When asked how evolving Internet technology may impact ethics, Dershowitz pointed to issues of intellectual property theft and of public right to know, but said, ?It?s cutting edge.? (Dershowitz is on the case of Julian Assange, founder of Wikileaks, which leaked diplomatic cables.) Referencing both issues he added the caveats: ?Old answers do not apply? and ?There is no simple solution.?

In his ?Successful Entrepreneurship? class, Kellogg?s Clinical Professor of Entrepreneurship founder Lloyd Shefsky, has students discuss such questions as ethical obligations during a session he calls, ?The Right Thing?Ethics for Entrepreneurs.?

The session discusses an entrepreneur?s responsibility to board of directors, shareholders, customers, bankers, employees, the community and professionals like accountants and lawyers.

Shefsky would like to see more school-business partnerships for developing programs to cover today?s issues. ?I believe that B-Schools must attract big employers of MBAs to get involved with the schools and include faculty and students to create a meaningful program,? he said.

Asked about ethic trends, he said, ?The only trend I see is a recurring pattern of increased talk when someone big is caught, followed by an ebbing until the next time.?

As to ethical issues facing small business owners today, Shefsky said, ?Tight capital leads to pressures that often result in ethical problems, including attempts to reduce costs, ignoring contractual obligations, misstatements of facts, etc.?

He listed the most frequent excuses for wrong-doing as:

* What I?m doing is something the Board would approve anyway????????????????????????????????????????????????????? * This is just temporary; I?ll fix it later?????????????????????????????????????????????????????????????????????????????????????????? ???????????????* I?ve given the company so much; I deserve this.?

Shefsky tells his students that ethics is something they should have already learned from parents and clergy. JBN asked Shefsky, past president and over 30-year member and director of the America-Israel Chamber of Commerce, what he thinks Judaism teaches about business ethics?

He said: ?1.The concept that one should avoid even the appearance of wrong-doing is a great warning system. 2.?The concept that each individual is responsible not only for his/her own reputation, but also for that of the Jewish people. 3. Charitable thinking is good. However, the concept regarding charity can create conflicts with fiduciary duties to shareholders.?

Hedy Ratner, co-founder/co-president of the Chicago-based Women?s Business Development Center was asked about ethic policies that small businesses should follow in lieu of those applied to public companies and the professions.

?There are no ethics rules for small businesses, but there are moral principles of life you must consider as a business owner,? said Ratner. She emphasizes building trust between business and customers and between owner and employees, whether business is good or bad.

Ratner warned there are many ways to betray one?s principles by exploiting customers or employees. She urged small business owners to set an example of ethical behavior for employees. ?You don?t want an employee saying, ?this isn?t the company I thought it was.??

Having an ethics policy is good business, according to Ratner. ?Let employees know you have it and that you?re living it,? she said. ?Build trust with customers so they know they can trust you to give the best price and best service.?

She also emphasized the ethics of meeting obligations even during economic downturns. ?Instead of arbitrarily cutting salaries, talk to your employees. Explain business is not good, so let?s work together for a solution. When you negotiate, you get more concessions. When you impose, you lose,? she said.

?Being respectful and treating others with respect is part of behaving ethically.?

David I Jacobson, founder of Chicago Jewish Funerals and board member of several Jewish organizations, said that for some people, a funeral home sends up red flags. But he believes any business whose owner is ethical will have a good reputation.

?Ethics are pretty cut and dried. The Torah says you must behave in the right way. You must do the right thing all the time,? said Jacobson.

?I make sure my employees are taken care of. They?re the face of my business. If you devote your life to a company, you have to take care of your employees,? he said.

He also felt strongly about obligations, trust and respect. ?If you promise something, you better deliver what you promise and even more. We never take a short cut.?

As a guide, he suggested: treat a client like you would your family. People pay a fair price expecting that everything is right,? said Jacobson. ?There are cheaper ways of doing things. That?s not our way. It?s not good business.?

As an example, Jacobson said he parted ways with a huge insurance company because they cut staff he thought were necessary for personal contact and service.

?They fired their ground people, so I fired them. They offered incentives to stay with them. I didn?t accept because I didn?t want to work with the corporate office. You have to do the right thing,? he said.

Rabbi Karen Kedar, senior rabbi of B?nai Jehoshua Beth Elohim, Deerfield, edited the finance and ethics issue of the CCAR Journal (The Reform Jewish Quarterly of the Central Conference of Reform Rabbis) published spring 2010.

In her Journal introduction, ?Jewish Perspectives on Finances and the Marketplace,? Rabbi Kedar referred to the impact the economic crisis has on families and business. ?It seems that the rules have changed; banks aren?t behaving like banks; performance, ambition, and intelligence are irrelevant to job security. What was affordable in previous years is now out of sight,? she said.

She encouraged a review of attitudes toward wealth. ?Nobody stands at your grave and reads the details of your portfolio. Life is judged by giving, loving, faith, and the ability to rebalance when we?ve lost our focus.?

Rabbi Kedar explained the impetus for the journal?s issue as ?back to basics during a historic moment when ethical issues regarding money, finances, and business dealings are in question in our country, and indeed in the global marketplace.?

However, she cited an important reference from Shabbat 31a. ?It?s a powerful piece from the Talmud,? she said. ?May you live 120 years, but when you die, G-d asks you six questions. The first is ? were you honest in business??

Rabbi Kedar explained why honesty in business was first. ?The ethical order of money is the basis for everything,? she said. ?According to the Talmud, if you don?t have a society based on ethical behavior, than you have no foundation for any relationship.?

State Officials Sue Orange County For $73.5M In Property Taxes ...

LOS ANGELES (CBS)?? California state officials are suing Orange County for $73.5 million in property taxes.

The state Department of Finance and California Community Colleges Chancellor Jack Scott filed suit Thursday in Orange County Superior Court, in an effort to get the county to pay property taxes to schools.

The lawsuit says the county has taken ?the extraordinary step of flouting the law and illegally redirecting property tax revenue payments from schools and community colleges to the county?s own general fund.?

Since 1994, Orange County has been getting an extra share of vehicle tax money from the state, to help stabilize its budget after its bankruptcy. Because of its current budget crisis, the state cut off that extra money ? all $48 million of it ? so Orange County is now refusing to forward its usual share of property tax money that goes into the state treasury.

?The state is basically saying that the county didn?t get its way with the car tax money last year in the capitol so it chose another way to get this money from the state, and the county says its just taking what is due to them,? Sacramento Bee reporter Kevin Yamamura told KNX 1070.

The $48 million that the state redirected was paid out to counties for new responsibilities inherited from the state, such as housing low-level prisoners and overseeing parolees, according to the Bee.

The $73.5 million in property taxes was earmarked to fund K-12 schools and community colleges.

New Detroit slugger has sac fly, Jackson gets game-winning hit in bottom of the 9th

The Detroit Tigers' Prince Fielder hits a single during the second inning.

By NOAH TRISTER

updated 6:13 p.m. ET April 5, 2012

DETROIT - Justin Verlander was brilliant on the mound and Prince Fielder drove in a key run with his bat. Still, after a rare slip by Jose Valverde, the Detroit Tigers were all tied with Boston in the bottom of the ninth.

Up stepped Austin Jackson - Detroit's strikeout-prone leadoff man - needing only a little poke through the infield to win the game.

Jackson delivered, hitting a sharp groundball past third with the bases loaded to give the Tigers a 3-2 win over the Red Sox in Thursday's opener.

It was Jackson's third hit of the game, and it enabled his team to leave the ballpark happy on a day Verlander once again looked impressive.

"I get the strikeout questions a lot, but it doesn't bother me. I understand," said Jackson, who fanned 351 times in his first two big league seasons. "I stayed with the approach as far as just putting the ball in play, and it worked out."

Verlander, last year's AL MVP and Cy Young winner, was dominant for eight innings and left with a 2-0 lead. But Valverde (1-0) blew a save for the first time in 52 chances, a streak that included 49 in a row last season.

Tigers manager Jim Leyland sounded almost relieved after Valverde's first blown save since 2010.

"When I say this, I mean it: In a way, I'm glad that streak's over," Leyland said. "It puts that behind us and we can just go forward."

Boston manager Bobby Valentine lost in his return to the major leagues after replacing Terry Francona following the team's 7-20 September slide that cost the Red Sox a playoff spot last year.

"There was a lot I saw that I liked. Lester was terrific. He did just what he needed to do," Valentine said. "Verlander was very good. A lot of pitches on the outside corner were perfect pitches. We knew he was good and he's still good if anyone is wondering."

Valentine brought in Mark Melancon (0-1) to start the Detroit ninth, and he allowed one-out singles to Jhonny Peralta and Alex Avila.

Alfredo Aceves entered and hit Ramon Santiago with a pitch, and Jackson came through with a single past diving third baseman Nick Punto to win it.

Fielder singled his first time up for the AL Central champions and added a sacrifice fly in the eighth after Jackson had tripled.

Verlander walked one and struck out seven. It was his fifth consecutive opening day start - and fourth no-decision. Verlander has had problems in April throughout his career.

"This was the best opening day I've had, and hopefully that goes toward all the hard work I've been putting in to get off to a better start," he said. "Long way to go, but it's good to get that first one under your belt and have it be a good one."

David Ortiz hit a sacrifice fly off Valverde, and Ryan Sweeney's two-out triple off the wall in the right-field corner tied it.

Boston's Jon Lester allowed a run and six hits in seven innings. He struck out four and walked three.

Detroit put a runner on base in every inning but didn't score until the seventh, when Peralta and Avila hit doubles with two outs.

Time to tap into oil reserves - again?

"Here we are again." That's what President Obama said to me at the White House on Wednesday (video below).

Almost a year ago, at a meeting on June 8, 2011, with a group of financial journalists, I asked President Obama if he was considering releasing oil from the Strategic Petroleum Reserve as a way to lower oil and gasoline prices. At the time, oil was about $95 per barrel and gasoline had recently hit $4.00. The president demurred, implying it would be a sign of panic and wouldn't do all that much to change the dynamics in a complicated global industry. Fifteen days later, Obama ordered the release of up to 30 million barrels from the SPR into the system for refining. Gas prices fell, but the release of what amounts to about 4.5 days of U.S. crude production didn't have much of a long-term impact.

On Wednesday, at another meeting with a group of financial journalists, I asked a follow-up question. (Check out the video above. The click-clack in the background is the sound of my furious typing). With gas this high, would he consider releasing crude from the SPR again? And what had the White House learned from the last release? In response, Obama channeled energy analyst and oil expert Daniel Yergin, giving a brief dissertation on oil prices.

"As I've said publicly, there are no silver bullets when it comes to gas prices," Obama said. "Everybody here understands oil is a world commodity." He noted, correctly, that U.S. oil production in 2011 was at its highest level since 2003, that the economy has become more efficient, and that imports now account for less than 50 percent of total usage. "We've used less oil each year that I've been in office."

Obama argued that two significant global factors beyond his control ? or any president's control ? are helping to push oil prices higher. First, "a little over a million barrels a day [in production] that have been taken off the market in dribs and drabs." He said that Sudan's production is off by a "couple hundred thousand barrels, Yemen maybe a hundred thousand. Recently the Kurds took 50,000 to 70,000 off the market." None of these moves is significant on its own, he said, "but cumulatively we have a significantly larger amount that's been taken off than is typical." Second, Obama argued that prices are higher in part because of the "risk premium that folks are looking at because of possible conflict in the Middle East." Translation: Instability in the region in general, and concerns about a potential conflict with Iran in particular, are making oil more expensive.

The president found a bit of sunshine in the mix. Europe's congenital weakness is acting as something of a brake on oil prices. "So, if it weren't for those two other factors, we would potentially be in a position where the U.S. economy could grow without gas prices being driven up significantly." Of course, that's sort of like me making reference to my 20-inch vertical jump and chronically dislocating right shoulder and saying that "if it weren't for those two other factors, I'd potentially be in a position to play starting forward for the Oklahoma City Thunder." Production slips and Middle East tension are likely to be near-permanent factors.

So given the stubborn persistence of high prices, I asked, why not consider releasing some more crude from the SPR? It would provide some measure of relief to consumers at a crucial time ? in 2012, the summer driving season and the political season conveniently coincide. And in recent weeks, there's been some discussion about a coordinated release from petroleum reserves in the U.S. and Europe.

"We're looking at all of this very carefully," Obama said. "I don't engage in a SPR release lightly. You have to factor in how effective it's going to be, how much participation we get internationally," and whether the major producers will support it. "So I will not be making any news today but I appreciate the effort to try to make some news."

If past performance is any guide to future performance, this can only mean one thing: more oil to be released in time for the summer driving season.
